Court dismisses Polokwane municipality interdict

The Limpopo High Court on Friday dismissed with costs the urgent application by the Polokwane municipality to interdict the DStv Premiership match between Marumo Gallants and Kaizer Chiefs.

The match, which was originally scheduled for Peter Mokaba Stadium, was changed to Royal Bafokeng Stadium by the club.

This is after the club was offered R 3.5 million by the North West department of sports arts and culture to take their big matches to the stadium in Phokeng.

The municipality took the club to court for breach of contract. But Judge Gerrit Muller dismissed the application with costs.

Manager of Sport and recreation at the municipality Manhlako Sebaka said the decision took them by a surprise.

“Obviously we are disappointed because we thought facts were put on the table for all to see. But the judge saw something else,” Sebaka told the media.

“We are really disappointed because our case was quite solid and it is still solid so we were not expecting this to happen.

“Atleast being fair with facts, it could have been easier for anyone to come to a particular decision. But this time around we are still flabbergasted as to how did the judge come to such a decision,” he said.

Meanwhile, Gallants Chairman Abram Sello was a relieved man following the judgment.

“We are very much relieved and thanks very much to God for helping us to be where we are right now. We didn’t sleep for almost two weeks since this court proceedings started. Now it has come to an end, let’s go fight the battle in the field of play.

“It was very stressful. Remember this was on urgent basis. They it in midnight and we had to wake up to call the whole world to find someone to come and represent us.

“You can’t represent yourself. So, that’s why I’m saying I’m relieved without judging anybody. I think we have still got a lot to do with the squad,” he said.

“The team has travelled to Rusternburg. They trained there this morning and they were happy to hear that partial judgment in the morning. But remember the pain and the stress affected us because the case had its ups and downs.”
