Tebogo Motlanthe to take on SAFA in a legal battle

Former SAFA CEO Tebogo Motlanthe is set to take on the football motherbody in a legal battle scheduled for Tuesday afternoon.

Motlanthe, a legal practitioner by profession, resigned from his position as SAFA CEO last month citing personal reasons. A few days later, reports emerged that Motlanthe could be heading to the PSL or CAF.

In the meantime, Motlanthe has been listed as the legal representative for Gauteng-based amateur side Mmamatho FC.

Mmabatho participates in the SAFA Sedibeng Regional League Stream A and finished second on the official league log updated on https://inqaku.com/ [the official platform of all SAFA League logs]. 

The club is embroiled in a legal battle with SAFA Sedibeng as the first respondent and Real Hearts FC as the second respondent. Real Hearts finished as number one, two points above Mmabatho. The winner of the group will take on the winner from Stream B for a place in the provincial playoffs to the ABC Motsepe League. 

Mmabatho are appealing a decision taken by SAFA Sedibeng to award a walkover in favour of Hearts against them. They claim that the decision was taken without following the right procedures and incorrectly.

The fixture in question [in which Mmabatho was the home side] was rescheduled more than twice for different reasons.

Mmabatho allegedly did not pitch up on the final rescheduled date. According to the association, they also contravened Rule 28.3: of SAFA Uniform Rules. It states that if there is no match played due to late or non-arrival of a team. The offending team shall forfeit match points and may be charged with misconduct. The offending team shall forfeit the match points.

But in a document seen by FARPost, on behalf of Mmabatho by their Legal representative Advocate Motlanthe, the club wants amongst others the decision by SAFA to be set aside. They also want the match to be played to determine the ”real’ winner of the stream. 

The hearing will sit virtually at 14:00 this afternoon. Efforts to solicit a comment from Advocate Motlanthe or Mmabatho team manager Dzunisani Babane were fruitless.
